General

Your use of the Boomer’s Field Walks website, including mobile and all other media is subject to these Terms & Conditions and all applicable laws. By using the Boomer’s Field Walks website you agree to be bound by these Terms & Conditions. This document is intended to set out the way in which Boomer’s Field Walks Ltd collect, hold, disclose, use and protect The Client’s personal information and to set out exactly what we offer our clients and what we expect in return from them.

Please note, in this document “we” and “our” is defined as “Boomer’s Field Walks”. Also, when stated “you”, “your”, “clients” & “the user” is defined as “The Client”. The “website” stated in our Terms & Conditions and Privacy Policy is the website of Boomer’s Field Walks. Please find our website link here: https://boomersfieldwalks.co.nz/. References to “website” also include web services and all media managed by Boomer’s Field Walks.

Revisions

We recommend that you read the Privacy Policy and Terms & Conditions each time you visit our website. Revisions to this policy may occur occasionally that may have an effect on you. If necessary, we may contact you directly via email, but generally updates will be on our website. However, if we feel it is necessary, we may contact you via email or by post if email is unavailable.

Information Collected and Why

We use your information for a variety of purposes, including but not limited to the following:

We collect personal information from you necessary for us to process your booking, process a refund, register you an account for the scheduling app, to determine how many visitors to our website to prevent fraud, comply with any legal obligations or information required by law. 

Where possible we will give you the option to interact with us anonymously.

Information collected about you; name, contact information may include phone number and email, location, pet information, IP address, computer or network, interactions with us, booking, billing and purchase information. 

We may collect your personal information in order to; make amendments to our services so our clients have the best experience possible, fulfilling prizes from competitions, conducting market research and keeping you informed about any website changes as well as products and services. 

Besides our staff, we may share this information, if necessary, with a third party in order to take actions connected to a purpose for collection.

Providing some information is optional. If you choose not to enter your contact details when booking over the phone or online, we will be unable to provide you with certain services.

We keep your information safe by storing it in encrypted files and only allowing certain staff members access to it.

We keep your information for two years at which point we securely destroy it by securely erasing all digital files.

You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong. If you’d like to ask for a copy of your information, or to have it corrected, please contact Vicky at vicky@boomersfieldwalks.co.nz.

You may update your Boomer’s Field Walks Scheduling Account details at any time. You can do this by signing into your account and clicking on the edit button. 

How your information is collected

We collect your information in various ways, these include, but are not limited to, when you; give google reviews, visit our website, register to book services online, order/purchase products online/phone/in person, use an eVoucher & submit any feedback or queries. Please be aware your information is collected if you interact or follow any social media of Boomer’s Field Walks e.g. “like'' or partake in competitions on our Facebook Page or Instagram. 

Correspondence via Email/Unsubscribing

To stop receiving any email correspondence from us, like great deals and other information, simply click the unsubscribe link at the bottom of the email.

Animal Welfare Act 1999 and Dog Control Act 1996

Boomer’s Field Walks strives to provide the best possible care for your dog/s while with us. We take your dog/s care very seriously. Boomer’s Field Walks environment is an Animal cruelty & Abuse free zone including while in transport. Boomer’s Field Walks will abide by the following rules for the safety and protection of your dog/s.

Insurance

Boomer’s Field Walks will not be liable for any costs, claims, damages, charges whatsoever, including medical and dental costs, while in the care of Boomer’s Field Walks.

Service Agreement Forms

As a new Client, you must fill out a “Service Agreement Form” before service can take place. If this is not filled out, We can not carry out Services for your dog/s. You must also confirm you have read and understood the “Terms & Conditions” form before services are carried out.

Social Media

By visiting our website, creating an account, purchasing services, making bookings or providing us with your personal information, you agree to your personal information to be collected, held, used and disclosed as per our Privacy Policy and Terms & Conditions of Use. 

Boomer’s Field Walks website may be accessible through or contain connections to areas where you may be able to publicly post information, communicate with others, review products and submit media content. Before posting in these areas, please read our Terms & Conditions and Privacy Policy. All of the information you post may be accessible to anyone with internet access and any information you include in your posting may be read, collected and used by others.

User submissions like hosting, sharing and/or publishing written works, photos, audio files, videos or other communications submitted by you through the website or social media managed by Boomer’s Field Walks become the property of Boomer’s Field Walks. We do not guarantee any confidentiality with any submissions. You agree that Boomer’s Field Walks may publish your name and submissions on our website, social media, advertising, printed material or in any other media items.

Boomer’s Field Walks reserves the right to remove content and submissions without prior notice.

Third Party Disclosure of your Information

The Privacy Policy and these Terms & Conditions apply to all users of Boomer’s Field Walks Website. Boomer’s Field Walks website may include information or links to Third Party websites. Please be aware that by accepting these Terms & Conditions you agree Boomer’s Field Walks has no liability for any use of your information from these Third Party websites. Before disclosing any personal information, we recommend that you read and accept the Third Party websites Privacy and Terms & Conditions.

Boomer’s Field Walks will share your information between themselves and with other third parties for the purpose for which the information was collected or for other reasons including, but not limited to; to meet the purpose for which it was submitted e.g. payment processing at Paypal.  

Our gateway provider for payments is Verifone. If you use a Credit Card to make a booking via our scheduling app or mobile site, your details will be passed on to our credit card processor who will receive and process your credit card details for those orders. The service we use is Verifone. Verifone is a secure internet payment gateway. See https://www.verifone.com/en/nz/gateways for more details.  

If you use PayPal to place a booking payment via our website or mobile site your details will be received by PayPal in order to process the order. If you place a booking payment online and express interest in third party offers, products or services, we may provide and share your information with the providers of those third party offers so they can contact you directly regarding advertising and marketing.

Boomer’s Field Walks will not be held liable for any damages caused by Third Parties.

Website/Cookies 

Boomer’s Field Walks gives its permission for you to access its website in agreement with the Privacy Policy and these Terms & Conditions provided you comply with these Terms & Conditions and you use the website for its intended purpose of goods and services e.g. contacting us at Boomer’s Field Walks and not use it for seeking other users information.

We use cookies on our website. Cookies are like a packet of data containing for instance a username and password. Cookies are used to identify your computer as you use a computer network. Mostly, they are used for convenience, like not having to type in your username and password every time you want to order with us. It is the users choice to enable cookies, however if you have cookies disabled you have not be able to access parts of our website. Please note, you can clear your cookies history from your computer or mobile device if you want to, simply go to your browser settings.

We cannot guarantee the Boomer’s Field Walks website or online shop will be error-free or virus-free. You agree that you will not hold Boomer’s Field Walks liable for any claim, loss, expense, or harm suffered by you or your devices as a result of using the website, online ordering and reserves the right to alter the agreed price if an incorrect price was caused by a software fault, error or malicious attack.

Payment Details/Refunds/eVouchers/Booking Payment/Internet Banking

All pricing of products are in New Zealand Dollars. All payments must be made using New Zealand Dollars.

When purchasing onsite (face-to-face) we can accept cash only. 

Payment can be made via internet banking. We will invoice you on the same day of service unless stated otherwise. Boomer’s Field Walks invoice payment is due within 7 days. If payment is not made within 3 months of the due date, we will contact and use debt collection services and you will be liable for those costs. 

If using internet banking, you agree to take reasonable care to protect your password and to notify your bank immediately if you suspect it has been compromised. Please be aware that you are liable for losses resulting from unauthorised transitions if you have not taken reasonable steps to protect your access credentials, or if you have delayed reporting a breach.

Online booking payments can be paid using Paypal, credit card or eVoucher. Your credit card details are required to process payment on our scheduling app but the full details are not saved once the order is processed. The details for credit cards we do hold are; Name on the card, expiry date and some digits but not all e.g. 123456******7891.

Boomer’s Field Walks strives to achieve the Consumer Guarantees Act New Zealand requirements. We want our customers to be happy. We may refund you. If required we may ask you bank details to process a refund. This will be done via email or by post if email is not available. eVouchers are available for purchase from our website. eVouchers are like a digital gift card that can only be used once at booking app via our website and are not redeemable for cash or transferable. eVouchers have an expiry date of 1 year. However if you have an eVoucher and Boomer’s Field Walks is no longer in business, you will need to apply for a refund at vicky@boomersfieldwalks.co.nz.

To use an eVoucher, simply enter the code from the eVoucher at checkout. Boomer’s Field Walks reserves the right, in its sole discretion, to cancel any eVoucher code, or refuse to honour any eVoucher code (including after it has been redeemed by the customer), if Boomer’s Field Walks suspects that the eVoucher code has been fraudulently generated and/or circulated without Boomer’s Field Walks authorisation. 

If you create an account with our scheduling app you may have the ability to save your preferred payment method. Boomer’s Field Walks do not hold these personal account details, they are held by our payment gateway provider, Verifone. Please refer to our section “Third Party Disclosure of your Information'' for more information about this provider. 

SuperGold Card Members

Only SuperGold Cardholder Members may take advantage of the SuperGold Card Member discounts. You must show your SuperGold Card upon collection of your order (some exclusions apply) or you will be charged full price.

Online Scheduling Account

You may provide your personal information, through Boomer’s Field Walks scheduling app, via the website, to register an account. When your account is registered you will be able to save information like bookings and payment details for a more efficient and easy booking experience. If you do register an account with our scheduling app you may be sent special discounts available only to registered account holders. If you no longer want to have a registered account, please let us know and unsubscribe from our mailing list. You are responsible for the confidentiality of your personal details, password and payment details. You acknowledge that when you access the website or login as a registered account holder, you may remain logged in to the website even after closing the internet browser (unless you log-out prior to leaving the website or erase your cookie data). If you sign into your registered account on a shared/public computer and do not sign out, someone else who uses the computer after you may be able to access your Boomer’s Field Walks account. We recommend that you log out of all services when you have finished using a shared/public computer.

Account Termination

If you breach any of the Terms & Conditions or do anything else with your account that is unlawful or not allowed including, but not limited to; Access data you do not have the permission to access, breach terms, be misleading or fraudulent, infringe on someone else's rights, upload viruses or malicious code; we may choose to suspend access, cancel or ban your account. We are not required to provide you with prior notice of those actions. 

If you no longer want or need your Boomer’s Field Walks Account you may delete it by signing into your account and removing your details. If you have trouble with this please let us know.

External Online Ordering Account

You may have the option to create a Boomer’s Field Walks account using an existing external account e.g. Facebook or Google. You acknowledge and agree that your Boomer’s Field Walks account will only be active whilst your external account remains active and that your use of the external account is governed by the external account provider's own Terms & Conditions and Boomer’s Field Walks will not be responsible for anything to do with your use of the external account. 

Intellectual Property 

The text, graphics and code contained in Boomer’s Field Walks website are the property of Boomer’s Field Walks and may not be copied, displayed or reproduced in any form or by any means without written permission from Boomer’s Field Walks.

Feedback/Complaints

Boomer’s Field Walks appreciates any feedback and complaints, it helps us grow  and improve our business. If you wish to lodge a formal complaint please do so in writing to our “Contact Us” page on our website. Alternatively, if email is not an option, please send to Vicky Gallon at 86 Victoria Street, Carterton, 5713, New Zealand. You will need to provide sufficient details regarding your complaint as well as any supporting information or evidence. If you are not satisfied with our response to your complaint or think we have breached the New Zealand privacy laws, you may send your complaint to The Office of Privacy Commission via their website www.privacy.org.nz.

Accept Terms & Conditions and Privacy Policy/If do not accept

By viewing and using our website, including mobile, you agree that; you are either more than 18 years of age, or possess legal parental or guardian consent, and are fully able and competent to enter into our Terms & Conditions of Use and that you comply with the Terms & Conditions and Privacy Policy. 

Boomers Field Walks reserves the right to refuse service, terminate your access to the website or booking app, remove or edit any content or cancel your booking/s in its sole discretion and without prior notice to you.

You do not have to give us your personal details. However, if you do not accept these terms, please note you may not be able to use our services and/or we may not be able to complete any services for you.

If you do not agree with our Terms & Conditions and Privacy Policy, please do not provide your personal information or interact with our website/other media.

Responsibility

Boomer’s Field Walks damages are capped at however much a customer spent on the purchase immediately before the alleged damage occurs. Boomer’s Field Walks will not be sued for any amount above however much a customer spent on their purchase or of a reasonable amount discussed and agreed to. Boomer’s Field Walks takes no responsibility for typos and description inaccuracies, but agrees to provide such accuracy as possible. We do not promise services or goods will always meet a customer's expectations but we will try our best in any case of course to provide high quality goods and services. We have the right to withdraw or cancel any services of Boomer’s Field Walks as we deem necessary at any time.
